After talking to a few more experienced folks about this hives location, we were told that moving them was impossible and that the situation of them being in peril in a hard winter was probably correct. So being the tree hugger type that I am we decided to go make some natural cover for them to give them a fighting chance to last the winter. For anyone that has stumbled on this the Before shots are here: Update for anyone who may find this photo, this hive lasted another three years after we covered it up, late in the 3rd year autumn badgers found the hive and destroyed it, but it took a long time for that to happen, being on the ground you would have expected that to happen right away.

Amazingly docile due to the cold, but I must admit I'm a bit concerned about them building a hive open and on the ground.
