nachdem der Biobauer einen alten Artikel aus Studentenzeiten wiedergefunden hat, erinnerte auch ich mich an einen Text, den ich irgendwann Ende der 80er Jahre aus einer Studentenzeitschrift herausgerissen und archiviert habe. Leider erinnere ich mich weder an den Namen der Zeitung (es war halt so eine, die an der Uni herumlag und jeder, der wollte, konnte nehmen) noch an das Datum der Veröffentlichung. Damals war sowas nicht wichtig ;-))) #plagiotoo

Beer Soul
Beer is my only stop in this world. A liquid anchor in a world of stone. I don't like this world. I am always sad because of this world.
In the Kaufhof (German department store) I see a wall full of televisions and the wall full of televisions shows me the world and from a radio comes a quiet melody and on the shelves are the computers and the Turkish popper at the checkout carries a Swatch. He accepts the money submissively. Thank you Massa. He who pays the piper calls the tune. Tears are bursting into my eyes and I hurry home. I drink a beer. The beer always tastes good to me and it comforts me and because I am always sad, I always have to drink beer. In the employment office I see the unemployed Malocher (someone between hard worker, salve, hustler) . Silently they wait in the corridor. Submissively they accept the refusals. Thank you Massa. Silently I wait with them. Then I feel again the tears in my eyes and I have to hurry home again and drink a beer. I always feel tears coming into my eyes when I see this world. And I always have to hurry home and drink a beer.
The beer says to me:
"You are a philosopher. Don't be sad because the world is so bad and the people so stupid. Through me you are a man. The others are young Malocher (see above) in Opel Mantas (a car similar to a Ford Capri) and old Malocher with smoker's cough. Drink me and you will feel for yourself what I mean. Wherever you are, you shall have me with you. I will show you the flight of the birds and let you hear the murmur in the leaves of the old horse chestnut trees. I am Alpha and Omega. I lead you to your beloved and you will unite under me and perhaps one day you will bear children in whose veins I will pulsate and whose play I will accompany on the meadows. And remember that your grandfather's last words were 'I want a beer'. Beer, that's me and you're a philosopher and through me you're a human being."
I say:
"Thank you beer. You show me that there is also a life and not only the Kaufhof and the job centre. I adore you, my beer. And once I have children, I will name them after you, and whenever you won't exist any longer, I will no longer be."

I was amazed when I went to Europe for the first time at age 21 and had "REAL BEER" for the first time...sitting in a London pub, I was amazed at the flavor and the STRENGTH of it. One mug and I was well and good drunk! Over the years I have discovered that there are actually many US beers which are equally flavorful, complex and not watery garbage like they used to be. Today the artisan beers are EVERYWHERE. Just in our little town of Medford there are at least THREE beer pubs which brew their own selections, and there is also a specialty beer shop that carries at least 100 kinds of beer from the US and around the world. It is such fun to try different kinds! Also, there is an incredible pizza restaurant that features a HUGE list of locally made, US, and imported beers...and few things go together better than pizza and beer! YO-HO-HO! :D
Thank you for this...it was fun to think about the wonderful beers in the world! :)

Die interessantere Frage wäre dann, ob fremde Verwertungsrechte verletzt wurden.
Es handelt sich beim Text nicht um ein Werk, für dessen Erwerb jeder Nutzer zu zahlen hat, wie beim Kauf von (geschützter) Musik, sei es jetzt als Datei oder auf einem Daten- oder Tonträger. Die Autorin wurde vielmehr vom Primäveröffentlicher (hoffentlich) bezahlt.
Letztlich wäre die Frage, ob es sich um ein zulässiges Zitat handelt, oder eine zulässige Kopie nach§ 53 (1) UrhG. MMn sind diese Voraussetzungen gegeben. Deshalb habe ich den Ausriß veröffentlicht.
Und jetzt darf ein anderer über Tatbestands- und Verbotsirrrtum schreiben ;-))))))
Ruesterstaude club has replied to Boarischa Krautmo clubIch kenne die einzelnen rechtlichen Grundlagen nicht so ganz genau, ich überlege nur, wenn ich etwas öffentlich machen will, ob das eventuell nicht im Interesse des Urhebers oder des Besitzers der Vermarktungsrechte liegen könnte. Ich achte wohl immer sehr darauf, die Quelle zu verdeutlichen, womit ich dem Urheber letztendlich einen Gefallen tue. Damit bin ich bisher immer gut gefahren.
Mir hat es dagegen einmal eine Person hier in IP schwer übel genommen, als ich durchblicken ließ, dass ich ihren wunderschönen Text als Plagiat erkannt hatte.
